This privacy policy explains the type, scope and purpose of the processing of personal data (hereinafter referred to as “data”) within our online offer and the functions and content associated with it (hereinafter jointly referred to as “online offer”). With regard to the terms used, such as “personal data” or their “processing”, we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

It is generally possible to use our website without providing personal data. For the use of individual services or functions of our website, different regulations may apply, which are explained separately in this privacy policy. Scope of application

This data protection declaration informs users about the type, scope and purpose of the collection and use of personal data by the responsible provider [ZOLLY & MUHAR Immobilien GmbH, 1100 Vienna, Gutheil-Schoder-Gasse 8-12] on this website (hereinafter referred to as “offer”).

The legal basis for data protection can be found in the EU General Data Protection Regulation (GDPR) and the German Telemedia Act (TMG).

Access data/ server log files

The provider (or its web space provider) collects data about every access to the website (so-called server log files). The access data includes

Processing of personal data

If you provide us with personal data outside of a contract, we process this data for the purpose communicated to you when the data was collected. As a rule, we will obtain your prior consent in this case. The data will then only be passed on to third parties to the extent that is covered by your consent. In individual cases, we may also be legally obliged or entitled to process your personal data due to our overriding interests. In this case, we will make this transparent to you as far as possible. If you have concluded a contract with us, we will use the data you provide to the extent that this is necessary for the fulfillment of the contract. In both cases (within and outside of a contract), your data will only be processed for purposes other than the original purpose if these other purposes are compatible with the original purpose

Deletion of the personal data processed by us

Your personal data will be deleted by us as soon as there is no longer any reason for further processing or storage. To ensure this, we regularly delete all old data. You can of course also request the deletion of your data at any other time (see below under “Data subject rights”). If we are legally obliged to store your data (e.g. due to tax regulations), it will be deleted after this legal retention period has expired.

Rights of data subjects / Your rights to protect your personal data

You have a number of rights in relation to your personal data processed by us. You can assert all these rights informally (by e-mail, telephone or post), if necessary after proving your identity, at the address given below. Your rights in detail:

  • Right to information: You can informally request information about the data we process at any time. In this case, we will inform you in writing of the data we have stored about you, the purposes for which we use it, the categories of recipients to whom we pass it on and how long we intend to store it. We will comply with your request for information without delay, but within one month at the latest.
  • Right to erasure: You have the right to informally request the erasure of your data processed by us at any time. We will comply with this request if your data is no longer required for the purpose for which it was collected, if you revoke any existing consent, in the event of unlawful data processing or if deletion is necessary to fulfill a legal obligation.
  • Right to rectification: If we process incorrect or incomplete data about you by mistake, we will of course rectify it. An informal request addressed to us is sufficient for this purpose.
  • Right to restriction of processing: If it is not possible to erase your data or if you do not wish your data to be erased, but you do not consent to its use beyond the storage of the data, we are obliged to restrict the further processing of your personal data at your request.
  • Right to data portability: Upon your informal request, we will provide you with the data we have stored about you, which we have received on the basis of a contract or your consent, free of charge in a standard file format. You can use this data for your own purposes and pass it on to future contractual partners. If you wish and if it is technically feasible, we will also transfer your data directly to an addressee named by you. In this case, we will inform you after the transfer has taken place. We will comply with your request without delay, but within one month at the latest.
  • Right to object: In certain cases, you also have the right to object to the further processing of your data under the General Data Protection Regulation. As we do not currently carry out any data processing in our organization for which the right to object applies, we refer you at this point to the right to erasure or the right to restriction of processing (see above).

Right of appeal

The EU General Data Protection Regulation and the Austrian Data Protection Act guarantee you the above-mentioned rights in the area of data protection. If you believe that one of these rights has been violated by our organization, you have the option of complaining to a data protection supervisory authority. In Austria, the Austrian Data Protection Authority, Wickenburggasse 8, 1080 Vienna, is responsible for this. Claims against us to which you are entitled on other legal grounds remain unaffected.

Contact us

When contacting the provider (e.g. via contact form or e-mail), the user’s details are stored for the purpose of processing the inquiry and in the event that follow-up questions arise.

Integration of third-party services and content

It may happen that third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites are integrated into this online offering. This always presupposes that the providers of this content (hereinafter referred to as “third-party providers”) are aware of the IP address of the user. Without the IP address, they would not be able to send the content to the browser of the respective user. The IP address is therefore required to display this content. We endeavor to only use content whose respective providers only use the IP address to deliver the content. However, we have no influence on this if the third-party providers store the IP address, e.g. for statistical purposes. As far as we are aware, we will inform users of this.

Cookies

Cookies are small files that make it possible to store specific information relating to the device on the user’s access device (PC, smartphone, etc.). On the one hand, they serve the user-friendliness of websites and thus the users (e.g. storage of login data). On the other hand, they are used to collect statistical data on website usage and to analyze it for the purpose of improving the offer. Users can influence the use of cookies. Most browsers have an option to restrict or completely prevent the saving of cookies. However, it should be noted that the use and in particular the ease of use are restricted without cookies.
